Therapy, jail ordered for molester
By JOHN WEBSTER (Chronicle Staff Writer)
Accused of making pornographic pictures of a 6-year-old Spokane girl with help from his 19-year-old wife, a 55-year-old man pleaded guilty in Superior Court last week to two counts of indecent liberties. Judge John J. Ripple placed Kermit F. Brooks on 20 years probation, committed him to Eastern State Hospital for a determination of whether he is a treatable sexual psychopath, and ordered that he serve two years in jail.
Ripple told Brooks, now of Seattle, that if he is deemed unacceptable for the mental institution's sexual psychopathy treatment program, he will be sent to prison. The two-year jail term. Ripple said, will begin as soon as Brooks completes the in-patient psychopathy treatment, which usually lasts a few years.
Defense Attorney John Nollette urged the judge not to send his client to prison, arguing that he probably would be killed there by fellow inmates, who have a well-known hatred for child molesters Nollette added that Brooks suffers from cirrhosis of the liver, diabetes and lung problems, among other things, and will probably die before the 20-year probationary term ends.
Deputy Prosecuting Attorney Patricia Thompson told the court that in 1978, the defendant and his wife were baby-sitting the young Spokane girl.
Brooks engaged in various sexual activities with the little girl while his wife took photographs, Also, she engaged in various sexual activities with the child while Brooks took pictures, the prosecutor said.
Investigators also found photographs showing Brooks engaged in sex acts with other young girls. Miss Thompson said.
There were indications that some photographs of the activities were sold, although it recently became more difficult to sell child pornography in western Washington, where the defendant resided, because of government crack downs there, the prosecutor said.
Betty Lynn Saferite, now 22, Spokane, who was the defendant's wife at the time of the activities, pleaded guilty earlier this week to two counts of communication with a minor for immoral purposes. Ripple allowed her to remain free pending a presentence investigation.
Mrs. Saferite told the court her husband forced her to engage in the activities. Her husband, on the other hand, contended she initiated the child molesting.
Miss Thompson told Ripple that at one point. Brooks told the 6-year-old she had better not tell her mother about the goings-on, threatening her with a rifle and a handgun.
The child, now 9, who has developed psychological problems, is now undergoing counseling. Miss Thompson said.

BOOK - HISTORY OF GOODHUE COUNTY, MN. PUBLISHED IN 1909
Charles Brown, now engaged in the coal, wood, coke and general transfer business, was born in Red Wing, July 12, 1868, son of Robert and Martha (McGarvey) Brown, natives of Ireland, who came to America at the ages of two and nine years, respectively. They spent their childhood in Canada and landed in Red Wing in 1856. The father at once purchased a farm in the township of Featherstone and continued farming until his death. For some time he was with Hamline University and also kept a boarding hall for the students of that institution. Robert Brown died in November, 1904, and his widow, who still owns the old homestead, now resides in Seattle, Wash., with her daughter, having reached the ripe old age of seventy-two years.
Charles received his education in the public schools and finished at the Red Wing Seminary. Upon completing his studies, he started life for himself as a clerk in the grocery store of Peter Kempe, at Red Wing. After three years he engaged in his present business in 1893, in which line he has since successfully continued. Mr. Brown was married December 26, 1894, to Lena M. Towle, of Red Wing, daughter of D. H. Towle, a farmer of Featherstone township in this county. Mrs. Brown's mother is now deceased and her father, who has remarried, is now living a retired life in Minneapolis, having sold his farm in Featherstone. To Mr. and Mrs. Brown have been born six children: Marian, born in 1895; Florence I., born January 13, 1897; Charles D., born January 24, 1898; Robert D., born August 21, 1901; Kenneth, born April 15, 1903, and Edward, born in September, 1908.
Mr. Brown is a Republican in politics and belongs to the Methodist Episcopal church. He affiliates with the Masons, the United Workmen and the Modern Woodmen. He has never sought public office. It is a matter worthy of somewhat extended note that Mr. Brown was chairman of the parade committee for the now famous celebration held in Red Wing, July 3, 4 and 5, 1909. With that energy that has characterized all his efforts, Mr. Brown set at work making the plans, and not only persuaded the leading business interests of Red Wing to participate in the parade, but also made a notable showing from his own stables. Seldom in any city in Minnesota has there been seen so fine a display of horses and vehicles as Mr. Brown had in the parade that day. Mr. Brown takes a personal as well as a business interest in his horses, being a lover of high-grade animals, and his stables contain some fine specimens of horse flesh.
