PAIR HELD AFTER 3 DIE IN CAR PLUNGE
Second Auto Occupants in Crash Jailed
Three Dashed to Death in Accident on Tenth Avenue Span.
Men Confess They Ran When Other Machine I Went Through Rail.
Police Declare Charges of Manslaughter Will Be Filed Today.

Two men were In jail Sunday night, held in the police investigation of an automobile accident that took three lives Saturday night when an automobile plunged through the railing of the Tenth avenue bridge and fell 70 feet to the Mississippi river. Bodies of the three victims were recovered Sunday after firemen worked for more than 10 hours with boats and grappling hooks. The dead are: Charles T. Tracey, 42 years old, 203 Nineteenth avenue south, owner and driver of the car. Clarence W. Score, 30 years old, 1816 Two-and One -half street south. Ludvig J. Forsbeck, 24 years old, 271 Nineteenth avenue south.

The men held in jail were occupants of a small coupe abandoned on the bridge after It had collided with Tracey's car. Police were told they ran from the scene after the crash, but later police picked up the driver after tracing the ownership of the car through the license number. He probably will face a manslaughter charge Monday, according to Detectives Frank Forestal and James Mullen. His companion gave himself up voluntarily.
They were questioned Sunday in an effort to trace their movements before the accident. One of the men denied having any liquor, but the other said they had visited a place on Cedar avenue where they obtained some liquor. A third man, who had been with the two before the accident, also was questioned by the police.
The body of Tracey was first recovered. It was brought to the surface at 4:30 a.m. Sunday by Patrol, men R. B. Nelson and J. T. Hofdahl, a short distance from where the car struck the water, above the rapids. Three hours more of searching in the river elapsed before Score's body was found, and after another hour and a half the patrolmen recovered Forsbeck's body.

Detectives Ray Mahoney and Magni Palm arrested the driver of the abandoned coupe, and the other came to police headquarters Sunday morning, explained his connection with the crash, and was locked up.
One of the men, the detectives said, gave a clear account of the accident. He said he was driving east on the bridge when he met the Tracey car. The front wheels of the cars locked, he said, and the larger car swung around back of the coupe, and plunged through the railing. He said his own machine then swung to the right and stopped on the edge of the sidewalk.
The two fled from the scene, they declared, and after reaching the university campus, separated, one going home and the other coming down town. The latter met a friend, he said, and started to spend the night with him, but the friend advised him to telephone his father about the accident. This was done.
Dr. Gilbert Seashore, coroner, after an examination of the bodies of the men who lost their lives in the accident, filed a verdict of death due to drowning after an automobile accident. Hie advised that police continue the investigation of the crash with a view to fixing responsibility.

Police were in doubt for some time as to who was in the Tracey car. It was at first believed that Ole Peterson, 3007 Pierce street north east and two companions were in the machine. Peterson at one time owned the car but disposed of it several months ago. Tracey, according to his son, has owned it for two months.

Survived by Widow.
Tracey is survived by a widow and three children, Everett, 17 years old; Donald, 10 years; and LaVonee, 3 years.
"The men who lost their lives with dad were friends of his," Everett, the son, said Sunday in discussing the accident. I don't know how he happened to be down on the Tenth avenue bridge. Dad and his friends left home early in the evening. He was supposed to be back In a few minutes because we had company coming, and it was planned to play cards and have lunch later in the evening. He never drove fast, in fact, he was so careful about the car that he never let me take it. I can't understand how the accident happened."

The body of Tracey was taken to the Hurlburt mortuary, 5 West Twenty sixth street. Funeral services for Tracey will be held Thursday afternoon at 2:30, from the Reorganized Church of Jesus Christ of Latter Day Saints, Fifth avenue north and Queen avenue.

Score Also Married.
Clarence Score was married but had no children. He had been a taxi-cab driver for several years. He was a resident of Minneapolis during his entire life and was educated and married here. He was a member of the Modern Woodmen of America, Besides his wife, he is survived by his parents, Mr. and Mrs. O. O. Score.
Funeral services will be held at the Bethany Lutheran church, Franklin and Twenty-fifth avenues south at 2 p.m. Wednesday. Burial will be in Crystal Lake cemetery.
Forsbeck was born and reared in Minneapolis and educated in the public schools here. Since leaving school he had been employed In a loop store and resided with his mother, Mrs., Hilda Forsbeck, who is the only survivor. He was a Mason.

Police Jail Bootlegger In Inquiry of Crash on Bridge That Drowns 3
Two in Car and Third Who Sold Liquor Make Statements About Accident That Sent Auto Into River

Three persons are under arrest today and the county attorney's office has begun an investigation of the accident in the center of the Tenth avenue bridge late Saturday night which caused a sedan to plunge with three men into the Mississippi river. The occupants of the car were drowned.
Statements were obtained from all three of the men under arrest. Two of them were occupants of the second car which figured in the crash but which was prevented from going into the water by the bridge railing.
Three Held in Jail
The third man under arrest, who is also reported to have made a statement to police, was jailed because one of the first two told police he had had several drinks in a place on Cedar avenue operated by the other.
Those under arrest are Walter Storey, 26 years old, 4255 Grand avenue, driver of the coupe; Carl Ellsworth Anderson, 35 years old, 509 Beacon street NE., occupant of the car, and Paul Johnson, 239 Cedar avenue.
In the statement signed by Johnson, he admitted having sold liquor at the Cedar avenue address at various times, and that Saturday he had sold drinks to Anderson and others. The liquor was moonshine an dspiked beer, according to the statements.
Police turned the statements taken from the three men over to Ed J. Goff, assistant county attorney, and he is investigating the case to determine what charges, if any, should be placed against the three. They are all in jail.
Stories Conflict
Two of the thre estatements taken by police state Johnson sold "spiked" beer and moonshine at the Cedar avenue place, and that Anderson, Storey and two others had been there Saturday, at which time they had several drinks. Johnson stated Storey was sober when he left the place.
Conflicting statements were made in the answers given by Storey and Anderson regarding the operation of the place but police raided it early today and arrested Johnson.
Victims of the accident were: Charles T. Tracey, 42 years old, 203 Nineteenth avenue N., owner and driver of the car.
Ludvig J. Forsbeck, 24 years old, 271 Nineteenth avenue S.
Clarence W. Score, 30 years old, 1816 Two and One-half street S.
The bodies were recovered Sunday in the river beneath the bridge by policemen. Patrolmen L. C. Hofdahl and R. B. Nelson, the first crew to take up that work, recovered the body of Tracey at about daybreak. Patrolmen V. S. Kaufman and A. F. Strand, who then took up the work, I recovered the other two bodies.
Storey Signs Statement
Storey gave his statement to police orally. When he had finished, he signed a transcribed copy of the tatement, which is as follows:
"I got home a little after noon. I cleaned up the car, had lunch, read a magazine, listened to part of the ball game on the radio, took a bath, shaved and then I dressed.
"I left home about 4:30 or 5 p.m., taking the car with me and going to Sabo's barber shop on Cedar avenue between Third and Fourth streets. After I got the hair cut, I got some cigarets at Jepson's, corner of Riverside and Fourth. I then met a fellow by name of Clarence Johnson. I took him home to Twentieth avenue S., between Sixth and Seventh streets. He works for the city, on bridges. I took him home at about 5:30 p.m. I waited for him to wash and dress, which was about 7 p.m. Then we drove up to seven corners, sat around and talked to him in the car.
Have Accident on Bridge
"Later on I met Cully, whom I have known for about three or four months. This was about 8:30 p.m. He got into the car at seven corners. I don't know where he works. Clarence Johnson left me about 8:15 p m., while I was In the car. When Cully came along, I asked him if he was going home and he said he was. We then went up Washington avenue to Tenth avenue S. over the bridge on Tenth avenue, and when about 100 feet over the bridge, we had an accident.

Q-You say you were In the car how long before you met this other I fellow?
About half an hour.
Q-- Up to this time you had been drinking? The other fellow ?
Not me. I could not say that he had been drinking.
Q-Had Clarence Johnson been I drinking?
No sir. He was sober.
Q--When you went to Johnson's home, did you have anything to drink?
No sir.
Q-- Give the facts regarding the accident.
Misjudged Distance
"I was going along from Washington avenue towards southeast. Then the other car came from the other direction. It is a narrow bridge and it was quite dark. We both had misjudged our distance. My left front and his left front el struck each other. His car swerved 30 or 40 feet and then went through the sidewalk, which is eight or ten inches from the floor of the bridge. We both got out of my car. We looked around and saw that the other car had disappeared. We became confused and walked over the bridge until we reached the university campus. There was a car on the bridge but we did not talk to anyone. I left Cully at the university campus.
Q-- Just previous to the accident, how fast were you traveling?
Goes to Friends' House
About 15 or 16 miles per hour.
The other car was going about the same rate of speed.
Q.-Where did-you go after you left Cully?
I walked over the Washington avenue bridge to about Third street I and Third avenue S.. where I met Harry Bjersing and Clarence Ahlm. I told them about the accident. I went to Harry Bjersing's home at 1810 Fifth street S., and stayed there up to the time of my arrest at 5:30 a.m. today.
Second Man Questioned
The man called "Cully," Carl Ellsworth Anderson, also admitted he was in the coupe when it collided with the sedan on the bridge. In his statement to police, he said he lived at 509 Beacon street SE , and that he was unmarried His answers to questions about the accident follow:
Q--Did you notice if the car swerved or not?
I didn't notice.
Q-- Do you remember on which side of the bridge you hit the sedan?
No, sir.
Q-- As soon as the cars hit, did you hear the other car go through the bridge?
No. I didn't.
Q--You both got out of the car, that is, you and Storey?
Yes. I thought he was going home.
Tried to Start Car Again
Q--Did Storey try to start the car again?
Yes sir.
Q--How long after the accident did Storey try to start his car up to go away.
I don't know.
Q-- When he couldn't start the car, what did you do then?
I said, "I'm going home."
Q--How long did you stay there after the accident?
A couple of minutes.
From this point, the statement agrees with Storey's about the two walking to the university campus, where they separated.

Forsbeck was also a native of Minneapolis. He had been employed in a loop store and resided with his mother, Mrs. Hilda Forsbeck, who is the only survivor.
Slow Speed Ordered on Bride
The bridge was built 50 years ago. About 35 years ago it was condemned to traffic, but a storm of protests arose and it was re- opened to light vehicular travel and foot traffic. Signs were then posted, and have been up ever since, prohibiting heavy loads and requiring all travel to be at a slow speed. The bridge has a narrow roadway, and is a steel type, supported on stone piers, and with a planking floor.

STORY ACCUSED IN BRIDGE CRASH
Failure to Stop After Accident Charged in Death of Three

Charges of failing to stop after an accident were lodged today against Walter Story, 4255 Grand avenue, motorist whose car was involved in a collision which plunged three men 70 feet to their death from the Tenth avenue bridge Saturday night.
The other occupant of Story's machine, Carl E. Anderson, 509 Beacon street NE., was still held without charge as John P. Arnoldy, assistant county attorney, continued an investigation into the fatal crash.
An alleged bootlegger, from whom Anderson said he and Story purchased liquor before the accident was turned over to police for investigation. Louis Schultz, 905 Nineteenth avenue SE., whom Story drove home shortly before the accident and who was held as a material, witness, was released.
The three victims of the accident were Charles T. Tracey, 203 Nineteenth avenue S., Ludvig J. Forebeck, 271 Nineteenth avenue S., and Clarence W. Score, 1816 Two and One-half street S.

COURT DEFENDS BRIDGE IN SUIT
Woman Denied Damages in Death of Husband

The Tenth Avenue bridge is not the antiquated structure it was pictured by Mrs. Andrea H. Tracey, 3815 Forty seventh avenue S., the state supreme court contended today in a 5 to 2 decision upholding the Hennepin county district court's refusal to grant her $75,000 in her damage suit brought against the city after her husband was killed in a fall from the bridge.
Mrs. Tracey's husband was riding in an automobile which collided with a car driven by Walter Storey, 4255 Grand avenue, on Aug. 17, 1929. The car in which he was riding plunged through the bridge railing and dropped 60 feet to the river, while the Storey automobile stopped at the curb. Tracey and the other occupant of the car were killed and Tracey's widow got $1,750 damages from Storey. The collision, and not the 57-year old bridge, was the cause of the fatality. the majority ruling of the supreme court held.
